Client Terms of Service of CUNSULT

 

Online advisory and e-learning platform/websites CUNSULT.com and CUNSULT.in and CUNSULT Advisor and Client applications (hereinafter referred to as CUNSULT) are operated by 1234 INTELLIMAP PRIVATE LIMITED. The specific features and functionality of CUNSULT are to be determined solely by the management of 1234 INTELLIMAP PRIVATE LIMITED and are subject to change or termination at any time, for any reason, and without notice.

YOU AGREE THAT BY USING THIS SERVICE YOU ARE AT LEAST 18 YEARS OF AGE AND YOU ARE LEGALLY ABLE TO ENTER INTO A CONTRACT.

This Agreement contains all the terms and conditions between a Client of CUNSULT (“you”/ “Client”/” Customer”) and 1234 Intellimap. By using the site, you are executing a binding agreement between 1234 Intellimap and you – as the Client. You should therefore read this Agreement carefully. If you do not agree to be bound by this Agreement, please do not request a consultation on CUNSULT or watch a webinar or engage in any other interaction on CUNSULT.

As a Client, you also are agreeing to the terms of the 1234 Intellimap Privacy Policy, which is incorporated into this Agreement.

 

 

Definition of Service

CUNSULT provides a platform where Clients can locate an Advisor and ask for advice, education or buy or see Courses, Videos and Articles and other resources. 1234 Intellimap will enable a Client to communicate with Advisors. This communication would require the Client to pay for services provided by Advisors. 1234 Intellimap makes no representation or warranty whatsoever as to (a) the willingness or ability of any Advisor to give advice or provide opportunities, (b) whether the Client will find the advice/recommendations/learning or opportunities provided by an Advisor as satisfactory, (c) whether the advice/recommendations/learning or opportunities the Advisor offers will provide an adequate answer to the Client’s question(s) or (d) whether the Advisor’s advice will otherwise be suitable to the Client’s needs.

1234 Intellimap does not refer, endorse, recommend, verify, evaluate or guarantee any advice, opportunities, information or other services provided by Advisors. Clients should not consider anything to be a referral, endorsement, recommendation or guarantee by 1234 Intellimap of an Advisor’s advice, opportunities, information or other services. 1234 Intellimap does not guarantee the validity, accuracy, completeness, safety, legality, quality or applicability of the content on the Site and anything spoken or written by its Advisors, including any information contained in Advisor profile. 1234 Intellimap will not be liable for any damages sustained due to reliance by Client on information, advice or opportunities provided by any Advisor. The advice or information provided by our Advisors is for informational purposes only and cannot be considered a substitute for professional advice.

In particular, advice rendered by experts in the vertical of medical, wellness and yoga is not intended to replace a formal licensed medical professional/patient relationship – such advice does not constitute a formal medical opinion, medical advice, or diagnosis or treatment of any particular condition, but only to assist the Client take an early decision to reach appropriate medical care from a qualified practitioner.

In the sector on legal services and law, as regards lawyers, it is clarified that their presence in this portal is not meant to be an advertisement for them in the pursuit of their profession. They are there only to assist students and other information seekers in their quest for academic and other preliminary knowledge.

Client hereby releases and agrees to hold harmless 1234 Intellimap, its directors, shareholders, officers, members, managers, employees, agents, successors, Advisors and assigns from any and all causes of action, claims of any nature and damages resulting from the advice of Advisors accessed through the Site or from the content of the Site.

Disclaimer of Warranty and Limitation of Liability

THE CLIENT ACKNOWLEDGES AND AGREES THAT THE CUNSULT SERVICE IS PROVIDED “AS IS”, AND THEREFORE THE CLIENT WILL NOT HAVE ANY CLAIM OR DEMAND VIS-A-VIS 1234 Intellimap IN RESPECT TO 1234 Intellimap’S ADVISORS, PROPERTIES, LIMITATIONS OR COMPATIBILITY WITH THE CLIENT’S NEEDS. THE USE OF CUNSULT IS AT THE CLIENT’S SOLE RISK. TO THE FULLEST EXTENT OF THE LAW, 1234 Intellimap EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, SECURITY OR ACCURACY.

1234 Intellimap EXPRESSLY DISCLAIMS ALL WARRANTIES FOR INFORMATION POSTED OR TRANSMITTED BY ADVISORS. IF A CLIENT DECIDES TO RELY ON INFORMATION PROVIDED BY AN ADVISOR FOLLOWING THE USE OF CUNSULT.com, THE CLIENT MUST EXERCISE A HIGH STANDARD OF CARE. THE CLIENT SHALL NOT HAVE ANY CLAIM OR DEMAND VIS-A-VIS 1234 Intellimap, ITS AFFILIATES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, MEMBERS, MANAGERS, EMPLOYEES, SUB-CONTRACTORS AND AGENTS IN RESPECT TO ANY SERVICE OR ADVICE THE CLIENT DECIDES TO RECEIVE AND/OR RELY ON. 1234 Intellimap WILL NOT BE DEEMED THE PROVIDER OR RECIPIENT OF ANY SERVICES OR INFORMATION ACQUIRED THROUGH CUNSULT.com. THE PURCHASE OF SERVICES IS EFFECTED AT THE CLIENT’S SOLE RISK.

**UNDER NO CIRCUMSTANCES WILL 1234 Intellimap, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, MEMBERS, MANAGERS, EMPLOYEES, SUB-CONTRACTORS AND AGENTS BE LIABLE TO ANY CLIENT FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF BUSINESS, REVENUE, PROFITS, USE, DATA OR OTHER ECONOMIC ADVANTAGE), HOWEVER IT ARISES, WHETHER IN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION OR ARISING FROM THE SERVICES OR ANY PROVISION OF THIS AGREEMENT. THE CLIENT ACKNOWLEDGES AND AGREES THAT 1234 Intellimap DISCLAIMS ANY LIABILITY WITH RESPECT TO ANY CLAIM, SUIT OR ACTION BROUGHT BY AN ADVISOR IN CONNECTION WITH PAYMENT FOR SERVICES BY THE CLIENT AND CLIENT AGREES TO INDEMNIFY AND HOLD 1234 Intellimap HARMLESS IN CONNECTION WITH ANY SUCH CLAIM.

IN THE EVENT OF A DISPUTE REGARDING ANY TRANSACTION CONDUCTED THROUGH CUNSULT.com, THE CLIENT HEREBY RELIEVES 1234 Intellimap, ITS AFFILIATES, THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, MEMBERS, MANAGERS, EMPLOYEES, SUB-CONTRACTORS AND AGENTS FROM ALL MANNER OF ACTIONS, CLAIMS OR DEMANDS AND FROM ANY AND ALL LOSSES (DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL), DAMAGES, COSTS OR EXPENSES, INCLUDING, WITHOUT LIMITATION, COURT COSTS AND ATTORNEYS’ FEES, WHICH THE CLIENT MAY HAVE AGAINST ONE OR MORE OF THE ABOVE.

 

Client Ethics

You warrant and declare that while you are using CUNSULT.com you will agree to and act according to the following rules:

  • 1234 Intellimap is not directly involved in any transactions between Client and Advisor. 1234 Intellimap does not control or verify the quality, relevance or accuracy of the advice, whether the Advisor is qualified to provide the specific advice, whether the Advisor is categorized correctly or in the most appropriate category to provide the advice sought by the Client or the accuracy of any postings on the Site or any transmissions through it by Clients or Advisors. Client will not seek any specific information that can break local laws or that which has risky subjectivity
  • Client consents to CUNSULT collecting and processing any personal information, as per the terms of 1234 Intellimap Privacy Policy
  • All interactions between Client and Advisor will be billed through 1234 Intellimap/its platforms, regardless of if the interaction is online or offline. Client agrees to abide by the pricing terms agreed upon while utilizing CUNSULT and to pay 1234 Intellimap for all services rendered to Client by Advisors
  • Client will not take any actions that may undermine, disrupt or manipulate the integrity of the Client feedback (rating) system on the Site
  • Client will not interfere with or disrupt the CUNSULT servers or networks connected to the Site
  • Client will not attempt to gain unauthorized access to other computer systems or networks connected to the Site
  • Client will not transmit through the site any unlawful, harassing, libelous, privacy invading, abusive, threatening, defamatory, vulgar, obscene, racist, harmful, or otherwise objectionable material of any kind
  • Client will not disobey or breach this Agreement or any other applicable instructions conveyed by 1234 Intellimap
  • For legal sector, only academic queries can be raised. The profiles are only for information purposes
  • Client will not violate any applicable local, state, national or international law, statute, ordinance, rule, regulation or ethical code
  • Client will not upload, post, e-mail, transmit or otherwise make available: (A) any information or material that infringes upon a third party right, especially intellectual property rights; (B) any third party advertisements, including banner exchange services; (C) any software viruses, Trojan horses, worms or any other malicious application; or (D) any information or material which may constitute or encourage conduct that is a criminal offense, civil wrong or which otherwise violates any applicable law
  • CUNSULT enables the transfer of files between Clients and Advisors. Opening any such files is at the sole risk of the Client. It is the Client’s responsibility to scan such files with an anti-virus software application prior to opening them. 1234 Intellimap is not responsible for any the transfer of any computer viruses, malicious software or other damage resulting from opening such files
  • Client will not stalk, threaten or harass Advisors or other Clients or infringe upon or attempt to infringe upon their privacy
  • Client will not discriminate on the basis of gender, caste, race or any other discriminatory social marker
  • Client will read and internalize the CLIENT TUTORIAL (Given below) in all interactions with Advisors on CUNSULT

Modifications and Termination of 1234 Intellimap

1234 Intellimap reserves the right in its sole discretion, and from time to time, to modify, amend the terms, fee structure, or discontinue, temporarily or permanently, the services in CUNSULT, with or without notice to Client. Client agrees that 1234 Intellimap shall not be liable to Client or any third party for any modification or discontinuance of CUNSULT services or for any losses or damages that may result to Client from such discontinuation or interruption of service.

1234 Intellimap services depend on various factors such as software, hardware and communications networks of 1234 Intellimap, its contractors and suppliers and factors outside its control. Hence, 1234 Intellimap cannot guarantee that CUNSULT will be uninterrupted or that it will be timely, secure or error-free.

1234 Intellimap may, in its sole discretion and for any reason or no reason, terminate Client’s participation in CUNSULT and refuse any and all current or future use by Client of CUNSULT.

Indemnification

Client shall indemnify, defend and hold harmless 1234 Intellimap and its members, managers, employees, representatives, agents and affiliates against any and all losses, damages, suits, judgments, costs and expenses (including litigation costs and attorneys’ fees) arising out of or in connection with any claim, suit, action, or other proceeding brought against 1234 Intellimap or such party, to the extent that such a claim, suit, action or other proceeding is based on or arises from: (a) any breach of any representation, warranty, covenant or agreement to be performed by Client according to this Agreement; (b) Client’s refusal to pay for services provided by any Advisor; or (c) any materials that Client had posted on CUNSULT or transmitted through it and/or any content on Client’s Website or otherwise provided by Client.

No Assignment

Client shall not assign his or her rights and obligations according to this Agreement, in whole or in part, whether voluntarily or by operation of law, without the prior, written consent of 1234 Intellimap. Any purported assignment by Client without the appropriate prior written approval will be null and void and of no force or effect.

Modifications to this Agreement

1234 Intellimap may change this Agreement, fee structure, or any part hereof at any time according to its absolute discretion and without any prior notice. Therefore, Client is encouraged to check the terms of this Agreement frequently. By using the service or Site after any changes, Client agrees to be bound by such changes to this Agreement.

CUNSULT and Advisors do not guarantee you the best choice or the best career. That has to be a product of your own analysis, foresight and diligence

Check your Account: Ensure you have enough time balance available

Greet: Greetings like “Namaste”, “Hello”, “Good Morning” etc. in a happy, joyful tone can set the pace for a good interaction

Be Respectful to the Advisor. Use of honorifics like “Maam” or “Sir” may be helpful

Introduce yourself: your name, your academic background, your career goals, what subject you are interested in before you begin to ask your question. It is better if the Advisor has some idea who they are speaking to

Don’t be in a hurry: Remember the best result comes from this being a two-way dialogue. Don’t be in a tearing hurry to just ask about the specific issue you have in mind. Get a more holistic picture. That would help you going forward

Encourage Advisor: Encourage Advisor to give his best with functional phrases like: “That is useful”; “I see”; “Sir, please tell me more …

Be Polite: Once you decide to end the consultation, go ahead, but do so gently; tomorrow you may want to come back to the same Advisor

Choose another Advisor: A single Advisor may not be able to offer a full-bouquet solution to your queries. Triangulate your query by talking to other Advisors. If you need more advice – end the first consultation politely – then choose another Advisor, from the wide list of advisors. Talk to multiple Advisors so that you get the best understanding of the subject

Be Civil: good behavior is the correct approach. Do not be blunt with the ADVISOR at any stage. Thank the ADVISOR and end the conversation with goodbye greetings like: “Thank You Sir”, “Goodbye”, “Namaskar,” “Nice talking to you” …

Rate the Advisor: If you found the consultation useful give a positive review to encourage the Advisor for the next time you consult

Prepare for Mentorship: If you are able to suitably impress the Advisor that you have talent and long-term potential, he may select you as a Mentee. Then you will show in his dashboard and the interaction will be easier.

 

Refund Policy for Client

 

A Client who is convinced that they deserve a refund can write to CUNSULT at support@cunsult.com giving full justification for seeking a refund. CUNSULT will examine representations on a case by case basis. Refunds where applicable are valid only for the minutes actually purchased from CUNSULT. All purchases of Courses are non-refundable.

Clients are expected to

(A) choose their Advisors and Courses appropriately

(B) communicate in a manner which will bring out the best in an Advisor

(C) ensure that their internet connectivity is effective during the cunsultation/viewing

(D) be mentally prepared adequately to comprehend the Advisor

(E) Buy the courses only after they have viewed the course promo and after they have read the course details.
